Terms and Conditions

Welcome to the Factoti Ltd trading as motionco ("the company") website ("website"). These terms and conditions ( "Terms and Conditions") are the terms and conditions upon which the company (“we/us”) of 5 Hanborough Business Park, Long Hanborough, Oxon, OX29 8LH make available to you the website together with the company service ("service") to allow you to purchase the company's products ("products").
By completing an order you agree to be bound by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions do not proceed with your online order and call us to arrange for an order form to be sent to you so you can complete your purchase.

Postage and packing for UK delivery is charged at the standard rate of £3.45. For orders placed by mail order and paid for by cheque, the delivery charge is £5.00 to cover additional costs.

1.1 We own, operate and make available the website and the the company service and we require you to register with us before ordering any product(s) via our service.
1.2 You agree to provide us with accurate and complete personal details and other information about yourself and you agree to notify us immediately of any changes which are relevant to your registration at the following e-mail address: info@motionco.co.uk.

2.1 All orders of products are subject to availability and acceptance by us. We will contact you in the event that any the product(s) you have ordered are unavailable. You will have the option either to wait until the product(s) in question are available from stock or to cancel your order.
2.2 In the event that we are unable to supply the products you have ordered and you have therefore decided to cancel the order we will reimburse your payment in full.
2.3 You may submit an order by clicking on the the product you wish to purchase. This will take you to shopping basket page which will provide further information about the ordering process generally.
2.4 You will be given clear instructions to follow that will navigate you through the order form and you shall be required to provide us with complete personal details, including accurate postcode of the intended recipient and all necessary payment details. We accept payment by PayPal and all major credit and debit cards.
2.5 Please complete all the boxes on the form. The boxes marked with an asterisk are mandatory. This is to ensure that we have all the necessary information to make a successful delivery.
2.6 You agree and acknowledge to check your order before submitting it.
2.7 Once you have completed the order form click on the button marked "Confirm Order" on the Checkout Confirmation page. As soon we receive your order we will send you an e-mail confirming your order details and advising you that your order is being processed.
2.8 Orders cannot be accepted from customers under the age of eighteen (18) years.

3.1 All prices and offers quoted are exclusive of VAT but prices including VAT (where applicable) are also shown on the product pages.

4.1 The cost of delivery of products is additional to the price of the products. The delivery charges for the UK and Europe will be calculated according to weight.
4.2 Incorrect delivery details may lead to delays in the delivery of your the product(s), so before placing your order, please ensure that you have included the full address details, including accurate postcode, of the intended recipient and your daytime contact telephone number in the event that any delivery problems are encountered.

5.1 Orders for products that have not been personalised or customised or purchased on a quantity basis for which a discounted price was available may be amended or cancelled at any time up to 14 working days beginning on the day after you have received the relevant products (the "Cancellation Period").
5.2 You acknowledge and agree that orders for products that you have asked us to personalise or customise cannot be amended or cancelled after the order has been placed and the Cancellation Period in clause 5.1 shall not apply.
5.3 Any products you return to us during the Cancellation Period must be in new and unused condition.
5.4 All products that you wish to return must be by prior agreement. Please contact Factoti Ltd to obtain a Returns Authorisation Numbe by clicking here to send a request by email. Products should be returned to motionco c/o Factoti Ltd, 5 Hanborough Business Park, Long Hanborough, Oxon OX29 8LH quoting the Returns Authorisation Number. Products lost in transit will only be refunded on proof of postage.
5.5 Any non personalised or customised products cancelled by you should be returned within 14 days of the date of your notice of cancellation.
5.6 We will credit the original purchaser's credit card excluding taxes, duties and delivery costs within 30 days from the date of notice of cancellation.

7.1 Whilst we agree to use our reasonable endeavours to ensure that the website and/or the service is fully operational and error-free we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the website and/or the service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the website and/or the service impossible or impractical.
7.2 We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the products or your use or inability to access the website and/or the service. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise or due to representations (other than fraudulent or negligent misrepresentations) provided nothing contained in these Terms and Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the products supplied.

8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the website and/or the service from time to time.
8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the website and/or the services for any reason at any time.
8.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions are held to be invalid or enforceable, the remaining provisions shall remain in full force and effect.
8.4 No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
8.5 If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms and Conditions.
8.6 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.
8.7 These Terms and Conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
